What Is New Jersey Division of Gaming Enforcement (DGE) and How Does It Regulate Online Casinos in NJ?

DGE was formed in 1977 with the goal to oversee gambling activity in the state of New Jersey. After the legalization of online gambling in 2013, DGE was put on the task of issuing gambling licenses to NJ online casinos.

As per Bill A2578 signed by Gov. Chris Christie, online gambling sites in New Jersey can only operate legally if they are partnered with one of the land-based casinos in Atlantic City. Casinos like Golden Nugget, Borgata, Caesars, Hard Rock, Ocean casino, Tropicana, and Resorts are all partnered with one or several legal online casinos in NJ.

In short, DGE’s mission is to assess whether an online casino applying for a license is fit to receive that license and further keep its operations in check. Once the assessment is made, the agency sends its report to the CCC (Casino Control Commission), which then makes the final decision of whether a particular casino receives a license and joins a group of NJ online casinos.

DGE’s overall objective is to maintain a stable and safe NJ online gambling environment. The DGE along with the Regulatory Prosecutions Bureaus ensure the enforcing the laws of the Casino Control Act in several areas of operation, including but not limited to accounting and internal controls, gaming equipment, rules of the games, regulations of the Division of Alcoholic Beverage Control, advertising, simulcasting, underage gambling and drinking, exclusion list violations, casino employee noncompliance.

A Brief History of NJ Gambling

Even though online casinos have only become a part of New Jersey’s gambling landscape in the last decade, the gambling in NJ dates back to the 1970s. That said, here’s a timeline that includes key years and events that shaped the state’s gambling history:

1977

Casinos were banned in New Jersey until 1976, when the residents of Atlantic City voted in favor of casino gambling in hopes of improving the city’s economy. It was only a year later that the New Jersey Casino Control Act was passed, and the plans for the first casinos to be built in AC were getting drawn. The state’s constitution only allowed casino gambling in Atlantic City, and to this day, legal casinos can’t be found in any other part of the state.

1978

Even though the residents of Atlantic City voted for the legalization of casino gambling in 1976, they had to wait for two more years for casinos to start welcoming their first customers. The first in line was Resorts International Casino (now called Resorts Casino Hotel) that opened its doors on May 28, 1978, on the location of the historic Chalfonte-Haddon Hall hotel. It was followed by Bally’s and Caesars that opened only a year later.

1990

Several more casinos opened in AC through the 1980s, but none of them made as much noise as an ambitious project from businessman and now former US president Donal Trump that was dubbed Trump Taj Mahal. The casino took a couple of years and over one billion dollars to be built before it was finally opened on April 2, 1990. Featuring over 120,000 sq/ft of gaming space, Taj Mahal was arguably the biggest casino establishment in the world at the time. It remained the highest-grossing casino in AC for the next 13 years.

2006

In 2006, the Unlawful Internet Gambling Enforcement Act (UIGEA) was signed to prevent offshore gambling by prohibiting the banks from processing payments directed to and from offshore gambling websites. This document essentially paved the way for the regulated online gambling industry in New Jersey. Only a few years later, New Jersey became the only state alongside Nevada and Delaware to legalize online gambling.

2013

On February 26, 2013, New Jersey Governor Chris Christie signed Bill A2578 that officially marked the era of legal online casino gambling in the state. This was actually a new version of the proposed 2011 bill, with the major addition being that online operators will only be issued a license if they partner with one of the land-based casino companies in Atlantic City. The goal of such a rule was to stimulate online gamblers to visit AC casinos by giving them the opportunity to earn special benefits through playing online and to further invigorate the city’s economy. In November that year, the first online casino in New Jersey opened.

2018

New Jersey played a major role in abolishing PASPA (Professional and Amateur Sports Protection Act) that served as the main rampant for the legalization of sports betting. With the Act out of the way, Governor Phil Murphy signed Assembly Bill 4111 in June 2018, making New Jersey the first state to legalize sports betting after Nevada. The Bill allowed NJ casinos and racetracks to established retail locations for accepting sports wagers.

2020

The online betting industry in New Jersey has been on an upward path in the last several years. Namely, the last five months of 2020 were all record-setting when it comes to bets wagered on sports. NJ bettors wagered more than $6 billion during 2020, beating the $5.4 billion record set by Nevada the previous year. 2021

While 2020 was thought to be the best year for NJ online gambling market, 2021 took it to new heights.
